Volunteers Donbass SOS they write that, in connection with the extension of permits to cross the contact line, they often receive calls for advice on what to do if:

  • you try to renew your pass, but the system writes that such passport data has already been entered into the system;
  • I submitted an extension, but for some inexplicable reason the application disappeared from the system;
  • “I press the “resubmit” button - nothing happens.”

Volunteers asked these questions by calling the SBU hotline. They were redirected to the Coordination Groups. The results of the communication are as follows:

Document reception is open from Monday to Friday from 9:00 to 17:00 (without lunch). The hotline is open 7 days a week. You can find out by phone whether you can cross the demarcation line. If there is a problem with your application on the portal, you can submit an application and copies of documents (passport and identification code) to obtain a permit in Mariupol (Engelsa St., 35-a). The application is not adjusted on the spot, but the data is transferred centrally. Correcting the application takes 3-5 days, if the application is submitted from scratch - 10 working days or 14 calendar days.

Data is entered into the database or corrected within 10 working days (in fact less). You need to call to find out if it's ready.

“In general, based on the results, we can say that, yes, it is difficult to get through, but it is possible. The consultants are willing to make contact and respond with a great desire to help,” the volunteers write.

Therefore, if you have a problem with re-registration, call the Coordination Groups - many problems with your application can be clarified immediately over the phone.

The access system between the militant-occupied and Ukrainian-controlled territories of Donbass began operating in January 2015. Later, the number of pass issuing points was reduced to only 4, as promised by NSDC Secretary Alexander Turchynov.

From March 25, 2015, the operation of these points was to change quite significantly. However, the Security Service of Ukraine’s system of electronic passes in the ATO zone never worked at full capacity. As stated by the Chairman of the SBU Valentin Nalyvaichenko, the system works (through the ass) only in test mode.

The official named the set purely technical reasons, in particular, in unreliable electricity supply and interruptions in the Internet. Apparently no one had previously thought that such problems could arise in the front-line zone. Just like pure snow in summer.

“There is not enough electricity, unreliable functioning of the Internet in the Lugansk and Donetsk regions, now in an emergency mode we are looking for opportunities for both backup power supply and additional computer programs, and additional servers,” Nalyvaichenko said in his defense.

But, as you know, even the “paper” system of passes in the ATO zone worked intermittently: there were huge queues at the points issuing passes, which is why bribery flourishes among controllers and carriers. Corruption, like an octopus, quickly entangled this newly introduced state structure. Hmm, maybe that’s why it doesn’t work as it should?

Although, it was not only the SBU officers who were unprepared. Chairman of the Donetsk Regional State Administration Alexander Kikhtenko also stated several times that the region was not ready to serve such a number of internal migrants.

In general, introduction electronic system omissions, which in theory should help solve the problem, is very similar to moving away from a “tainted” system to a system with the same conditions, but under a different name. The same people are handling the paperwork as before.

In this regard, the disinterest of officials in normal operation. Even the most complete provision of information is not on the website of the SBU or other government agencies, but on the website “Restoration of Donbass - Public Initiative” (the information below is from there). By the way, one of the volunteers discovered that one of the email addresses was not working. Then he called the hotline of the Security Service of Ukraine and asked to explain why this was happening. The reaction was not entirely adequate and a verbal altercation ensued.

And, in general, the electronic pass system is for those who have the Internet and know how to use it. Not everyone has a scanner to send documents either. Although here you can use digital camera, they seem to accept it. But what if someone’s Ukrainian passport, say, burned down in their apartment, or was simply lost? To get a new one, you need to enter territory controlled by Ukraine. But a person cannot leave without a passport. He is doomed to remain in territory not controlled by Ukraine.

Transport corridors

Seven transport corridors have been identified for entry and exit from the ATO zone - five in the Donetsk region and two in the Luhansk region. According to updated information, some of them are intended only for the movement of citizens or only for the movement of goods.

Lugansk region:
1. “Stakhanov – Pervomaisk – Zolotoye – Gornoe – Lisichansk”, checkpoint Lisichansk;
2. “Lugansk – Stanitsa Luganskaya – Shirokiy”, checkpoint Stanitsa Luganskaya;

Donetsk region:
1. “Gorlovka – Artemovsk”, Nikolaevka checkpoint (for the movement of citizens);
2. “Donetsk – Volnovakha – Mariupol”, checkpoints Volnovakha, Bugas (for the movement of citizens);
3. “Novoazovsk – Krasnoarmeysk – Talakovka – Mariupol”, checkpoint Mariupol-1 (for the movement of citizens);
4. “Fashchevka – Debaltsevo – Artemovsk”, checkpoint Artemovsk (for moving goods);
5. “Donetsk – Kurakhovo”, checkpoints Kurakhovo, Georgievka (for the movement of goods).

On the territory of these corridors, special checkpoints for checking persons were installed. Crossing these points is permitted with a special document - a pass. On other road routes to/from the ATO zone, the movement of citizens and cargo is blocked and prohibited.

Grounds for crossing the border of the ATO zone

In accordance with the Temporary Procedure for monitoring the movement of persons, vehicles and cargo along the contact line within the Donetsk and Lugansk regions, citizens of Ukraine, foreigners and stateless persons entering and exiting uncontrolled territory have the right to freely and unhindered crossing of the contact line through checkpoints upon presentation of identification documents and entering personal data into the electronic register, in compliance with the requirements provided for such persons by the Rules for crossing the state border by citizens of Ukraine, approved by Resolution of the Cabinet of Ministers of Ukraine dated January 27, 1995 No. 57.
Organization and direct issuance of passes for individuals and legal entities, vehicles and cargo is entrusted to the Coordination Center at the ATO headquarters and sector coordination groups. The tasks of the center and sectors also include checking of persons wishing to cross the collision line.

Reasons for obtaining a pass

1) Residence of a person who is trying to enter an uncontrolled (controlled) territory by Ukraine directly on this territory. An acceptable basis for a person’s entry is also the residence of his close relatives or family members in this territory. In both cases, these grounds must be confirmed by documents issued by authorized state bodies of Ukraine.
2) The location of the burial site on the uncontrolled (controlled) territory of close relatives or family members, which is confirmed by documents.
3) Death of close relatives or family members in an uncontrolled (controlled) territory, which is confirmed by documents.
4) Availability of ownership rights to real estate that are located on uncontrolled (controlled) territory by Ukraine.
5) The need to participate in ensuring the national interests of Ukraine with the aim of peaceful resolution of the conflict, with humanitarian issues.
6) The need to perform functions within the framework of the activities of international organizations of which Ukraine is a member (exclusively upon application or agreement with the Ministry of Foreign Affairs).
7) Carrying out regular trips to uncontrolled (controlled) territory related to labor activity railway workers.

Bodies responsible for crossing the border of the ATO zone

To organize systematic entry across the border of the ATO zone, a Coordination Center was created at the ATO headquarters and Coordination Groups at the headquarters of sectors “A”, “B”, “C”, “M”. Coordination groups accept documents necessary for issuing passes (the procedure for submitting documents is in the next section). Registration is free of charge.

The said coordination centers and groups include representatives of the Security Service of Ukraine, the Armed Forces of Ukraine, the Ministry of Internal Affairs of Ukraine, the National Guard of Ukraine, the State Border Service of Ukraine, and the State Fiscal Service of Ukraine.

Package of documents for obtaining a pass and procedure for obtaining a pass

The pass regime applies to all citizens over 18 years of age. Information about minors is entered into the passes of their parents or legal representatives.
Submit documents to enter the ATO zone possible in three ways: 1) at the coordination center, 2) by sending documents to the address of the Coordination Group using traditional mail or by e-mail, 3) by transmitting the relevant documents through a checkpoint in the appropriate direction of movement.
Submit documents to obtain a pass to leave the ATO zone This is possible by submitting the relevant documents through the entry/exit checkpoint in the sector through which you are supposed to travel, as well as by email.
The person submitting the documents does not need to come to the coordination center for confirmation of permission to enter and exit the ATO zone. He must be contacted either by telephone or by e-mail and informed of the results of the review of documents. According to the statement of the adviser to the chairman of the SBU Markiyan Lubkivsky dated March 20, 2015, the issuance of a pass may be refused without giving a reason.

In order to receive a pass, you need to submit the following package of documents:

1. Statement, which describes the route of movement and the duration of stay in the ATO zone. Photo for the application size 5x5.

2. Passport(original and copy). The original is returned to the owner upon presentation.
3. A document confirming your stay on the territory of Ukraine legally (for foreigners and stateless persons). A stateless person or foreigner will need an identity document with personal data translated into Ukrainian language, as well as a document confirming that his presence on the territory of Ukraine is legal. The same list includes a document indicating the purpose of entry into the controlled territory and a document confirming the availability of sufficient financial security for the period of the planned location on the territory of Ukraine. In the absence of a document on financial security, the foreigner is obliged to provide the appropriate guarantees of the receiving party (the only exceptions are foreigners and stateless persons, who are issued a pass document under the conditions provided for in subparagraphs 4.5 of paragraph 7.3 of the approved Procedure).
4. A copy of a page of a passport document or stateless identity document, with personal data of the person, with a translation into Ukrainian, certified by in the prescribed manner(for foreigners and stateless persons);
5. A document (and its copy) confirming the purpose of entry into the territory controlled/uncontrolled by the Ukrainian authorities:
- document confirming residence in the ATO zone;
- certificate of burial place of loved ones in the ATO zone;
- a telegram certified by health care institutions about the death or illness of loved ones in an uncontrolled (controlled) territory;
- documents confirming ownership of real estate located in uncontrolled (controlled) territory;
- petition or approval of the Ministry of Foreign Affairs of Ukraine for persons specified in subparagraphs 4, 5 of paragraph 7.2 and subparagraph 6 of paragraph 7.3 of the Procedure for crossing the border of the ATO zone;
- other documents that can confirm the purpose of entry into the uncontrolled (controlled) territory - a certificate of illness of loved ones living in the ATO zone or outside it, a certificate from work, etc.
6. For foreigners and stateless persons - a document confirming the availability of sufficient financial security for the period of the planned stay on the territory of Ukraine or corresponding guarantees from the host party(except for foreigners and stateless persons, to whom a pass is issued under the conditions provided for in subparagraphs 4.5 of paragraph 7.3 of the Procedure).

Documents that are received by the Coordination Group and registered. After receiving and registering the application, the documents are transferred for verification and decision-making to the relevant employees in functional areas (MVDU, NGU, GPSU, SFSU, SBU).

The decision to issue passes is documented in a protocol signed by members of the Coordination Group and the Coordination Center. A travel permit does not grant the right to pass through checkpoints without proper inspection and verification.

Gaps and their types. Electronic access system

The pass is issued for single or multiple entry into and exit from an uncontrolled (controlled) territory and is valid for the documented period specified in the application.

According to SBU representative Markiyan Lubkivsky, the electronic system began operating in test mode on March 20. It was supposed to be fully operational on March 25 (then paper passes were supposed to become invalid), but on that day, SBU Chairman Valentin Nalyvaichenko admitted that the department was not ready to launch the system. A new launch date for the electronic system has not been announced.

If the electronic system starts operating, in order to obtain a pass via the Internet, you will need to submit scanned copies of the same documents that are submitted by mail or in person. The issuance of electronic passes to persons wishing to cross the border of the ATO zone must be carried out within 10 days. According to the SBU, people who received paper passes have already been entered into the electronic database.

According to the head of the State Border Service of Ukraine Viktor Nazarenko, electronic passes across the border of the ATO zone have the same details as paper passes. In particular, an indication of the specific checkpoint and sector to be visited. This means that, as before, permission is issued to cross the collision line only in a specific sector.

The “Temporary Order” provides for 4 types of passes for the civilian population:

1. Permanent pass No. 1 – for movement in all sectors of the ATO zone.
2. Permanent pass No. 2 - for the right to move in one of the sectors of the ATO zone.
3. Temporary passes giving the right to move within a specified period of time in one sector of the ATO zone.
4. Temporary passes giving the right to move within a specified period of time in all sectors of the ATO zone.

An electronic pass is issued for a period of 1 (one) year. The validity period of the pass cannot exceed the permitted time of stay of a foreigner or stateless person on the territory of Ukraine and must take into account the time required to travel outside Ukraine (at least three days).

Citizens must send scanned copies of the following documents to one of the email addresses:

1) a statement indicating the route of movement (through which checkpoints he will go), the period of stay in the ATO area (controlled or uncontrolled territory), photo 5x5;

2) passport (1-2 pages and with a current registration stamp) and TIN;

3) a document confirming the purpose of entry into the uncontrolled territory:

That the applicant or his relatives live in the territory of the ATO;

Ownership of real estate located in uncontrolled (controlled) territory;

That loved ones are buried in uncontrolled (controlled) territory;

Information about the death or illness of loved ones in the uncontrolled (controlled) territory;

Other documents that can confirm the purpose of entry into the uncontrolled (controlled) territory.

Procedure for submitting documents electronically:

Scan the required documents.
- Download the application form, print, fill out and sign, scan it.
- Attach all documents to a letter and send to the email address of the desired coordination center (it depends on the entry route). Wait for notifications on email or by telephone about entering data into an electronic database or refusing entry.

At the same time, according to the verbal assurances of the SBU speaker Lubkivsky, scans of any documents will not be required to leave the “DPR/LPR” - it will only be enough to report where and to whom the citizen is going. But the SBU has not yet given an official interpretation of this point.

Relatives of those who are in uncontrolled territories and do not have access to the Internet can help their loved ones and send scanned copies of their documents, adding them to the database.

After the documents are submitted, the data will be entered into the electronic register and processed in the database. Admission confirmations will be sent by email or phone number provided.

The SBU reported that after a person has received clearance, it is already in the electronic database.

List of things that can be transported across the border of the ATO zone

The Procedure for crossing the border of the ATO zone does not apply to goods transported to/from temporarily uncontrolled territories by citizens in hand luggage and/or accompanied luggage through checkpoints for their own needs not related to the implementation of entrepreneurial activity, namely:
personal items:
- personal hygiene products and individual cosmetical tools in an amount that meets the needs of one person for the duration of the trip;
- clothes, underwear, shoes that are of a personal nature, intended exclusively for one’s own use and have the signs of being used;
- personal jewelry, including those made of precious metals and stones, showing signs of being used;
- one camera, one film - video camera along with a reasonable amount of photo, video, film and additional accessories;
- portable musical instruments in quantities of no more than two pieces;
- one portable sound-reproducing device (including a tape recorder, voice recorder, CD player, etc.) with a reasonable number of films, records, discs;
- one portable radio;
- cellular (mobile) phones in an amount of no more than two, pagers;
- one portable TV;
- portable personal computers in the amount of no more than two pieces and peripheral equipment and accessories; flash cards in the amount of no more than three pieces;
- calculators, e-books in quantities of no more than two pieces;
- individual medical products for ensuring human life and monitoring his condition with signs of being used;
- regular and/or strollers in an amount corresponding to the number of children crossing the border with a citizen, and in the absence of children - in an amount of no more than one piece;
- one wheelchair for each disabled person;
- medicines in quantities not exceeding five packages of each name per person (except medicines containing narcotic or psychotropic substances);
- watches in the amount of no more than two pieces;
- 0.5 liters of eau de toilette and/or 100 grams of perfume;
- sports equipment - a bicycle, a fishing rod, a set of climbing equipment, a set of scuba diving equipment, a set of skis, a set of tennis rackets, a surfboard, windsurfing board, a set of golf equipment, and other similar equipment intended for use by one person;
- goods (except for excisable goods), the total invoice value of which does not exceed the equivalent of 10,000 hryvnia and the total weight of which does not exceed 50 kg per person;
- food products for personal consumption, the cost of which does not exceed the equivalent of 5,000 hryvnia and the total weight of which does not exceed 50 kg per person;
- goods intended for initial settlement, which are moved by citizens of Ukraine in connection with forced internal relocation, by decision and in the volumes determined by the Coordination Group in agreement with the Coordination Center.
- transportation of alcoholic beverages and tobacco products by citizens under 18 years of age is not permitted.
- citizens who have reached the age of 18 can transport alcoholic beverages and tobacco products in hand luggage in the following quantities per person:
- 200 cigarettes or 50 cigars or 250 grams of tobacco, or these products in a set with a total weight not exceeding 250 grams;
- 5 liters of beer, 2 liters of wine, 1 liter of strong alcoholic drinks (with an alcohol content of more than 22%).

Obtaining a vehicle pass

To obtain a vehicle pass, you must submit the following documents:
- A statement which must indicate the route of travel ( settlements), length of stay in the ATO area (whether it is a controlled territory or not).
- Photocopy of the driver’s passport vehicle.
- A photocopy of the technical passport for the vehicle.

For legal entities - a photocopy of a document confirming the right to use a vehicle (lease agreement, rental agreement, etc.).

Transportation of goods across the border of the ATO zone

Cargo transportation is carried out at a number of checkpoints along the routes: Lugansk - Shchastya - Novoaidar (checkpoint "Shchastye"), Donetsk - Kurakhovo (checkpoints "Kurakhovo" and "Georgievka"), Fashchevka - Debaltsevo - Artemovsk (checkpoint "Artemovsk"). At the checkpoint itself, the check should take no more than 24 hours.

List of documents for obtaining a vehicle pass:
1) a statement indicating the route of movement and duration of stay in the ATO zone;
2) originals and photocopies of the driver’s passport and technical passport for the vehicle;
3) a document confirming the right to own the vehicle (legal entities also provide a photocopy).

Only humanitarian cargo and cargo of legal entities registered in the territory controlled by Ukraine are allowed through the specified travel corridors to/from the ATO zone, if you have the following documents for the cargo:
1. Payment order for payment of VAT with a mark of a bank registered in Ukraine, according to a tax invoice (No. ___, date, according to the contract _____, date for a specific delivery batch).
2. Consignment note.
3. Invoice.
4. A certified copy of the certificate of registration of a business entity with the authorities state registration Ukraine.
5. A certified copy of a taxpayer’s certificate registered with the fiscal authorities of Ukraine, or an extract from the VAT taxpayer register.
6. A certified copy of the purchase and sale agreement.
7. Provided current legislation certificates of conformity for products.
When transporting coal, a certificate from the manufacturer of the mined coal is additionally required.

Applications for import/export of cargo (goods) are considered within the following time frames:
- humanitarian aid - up to 3 working days;
- goods for production needs - up to 10 working days;
- other goods - up to 30 working days.

Refusal to issue a pass

Before the introduction of the electronic pass system, a decision to refuse to issue a pass is made in the following cases:
1. When a person has created or may create a threat to the national security of the state or the protection of public order, ensuring health protection, protection of the rights and legitimate interests of citizens of Ukraine and other persons living on the territory of Ukraine.
2. When the passport document is damaged, does not correspond to the established sample, or belongs to another person.
3. When a person knowingly provides false information or forged documents.
4. When a person cannot prove the need to travel to the ATO zone.
5. If there is a suspicion that a person has taken part in violations of civil order.

At the same time, in his statement dated March 20, 2015, Advisor to the Chairman of the SBU M. Lubkivsky stated that With the introduction of an electronic system, the issuance of a pass may be refused without explanation.

Detention individuals and cargo at checkpoints on the border of the ATO zone

Cargo and persons not subject to entry will be sent to filtration zones created near the locations of the Coordination Groups. There, operational groups led by representatives of the State Fiscal Service of Ukraine will make decisions on subsequent detailed inspection and study of documents.
In the absence of the entire set necessary documents or identification of prohibited cargo, representatives of the operational groups will draw up an act on the seizure (confiscation) of the detained cargo.

Grade legal grounds introduction of passes for crossing the border of the ATO zone

According to lawyers, it is difficult to achieve the right to cross the border of the ATO zone as part of protecting one’s right to freedom of movement.
On the one hand, in Ukraine there is Law “On freedom of movement and free choice of place of residence”. Article 2 of this law states that “Citizens of Ukraine, as well as foreigners and stateless persons who are legally in Ukraine, are guaranteed freedom of movement and free choice of place of residence on the territory, with the exception of restrictions established by law.”
